The H-1B process for a non-profit is basically the same as for any other employer. The prevailing wage requirements apply.

Mine is approved I140. If USCIS doesn't ask for paystub then giving EVL of any consulting firm will solve the problem?
Also, my wife is working on EAD. Can she apply for H1 visa? Will it affect our GC process? I am the primary applicant.
A bonafide job offer is what is needed. You may want to contact lawyer personally and they will be able to guide you in this.

When it comes to the Visa Waiver program, clients often ask me, what happens when a Visa Waiver traveler who is in the U.S. visits a third, non-adjacent country, and then seeks to return to the U.S.? Do they receive a new 90-day period upon re-entering the United States? What if they go to Mexico or Canada or another adjacent country?
According to the CBP, An alien admitted into the United States under the Visa Waiver Program (VWP) who departs to visit a third country other than contiguous territory or an adjacent island and then returns to the United States to apply for admission as a temporary visitor for business or pleasure under the VWP, would receive a new 90-period of admission if he is found to be admissible.
If the same alien traveled only to foreign contiguous territory or an adjacent island, he would generally be readmitted for the balance of his original period of admission if found to be admissible. An alien is this situation may request to be admitted for a new 90-day period and be admitted for that new period if slbe is found to be admissible.
Please note that any VWP applicant for admission must establish his admissibility to the satisfaction of the inspecting CBP officers. An alien seeking a new 90-day period of admission under the VWP after departing the United States to "visit" a third country should expect to undergo greater scrutiny than most other VWP applicants. So this is possible but expect a tough time trying to get back in.

Folks make sure the A number is same in both applications, if they are different USCIS puts it aside and will not process, I found out today while getting my address verified with USCIS IO, they had entered my address wrongly.
WHile checking the IO said it was good that my wife's derivate app under me, and her self 485 App A numbers match. Otherwise, they put it in pending state forever.

Hi Friends,
I would like to know if anyone is working for this company,
http://www.qtech-solutions.com/
and how is the work culture in there generally.
They are a desi firm and willing to sponsor h1b work permit in biotech field.
Please share if you or anyone who know works for them
Sorry to post this here, but i did not know other means of trying to find out about them.
A google search of them brings very bad reviews of them, where employees have posted never join them. But it is hard to know if it was posted by people who just hate them or if they are genuine employees.
Please either pm me if you are not interested to reply.
Thanks for the help.

Hotel News Now, a leading Global Hospitality publication, ran a two-part series about staffing challenges facing the U.S. hotel industry. I was honored to be interviewed by the publication and share my insights on the problems facing hospitality employer in these challenging times.
With the level of unemployment about 8.5 percent, why do hotels still need foreign workers? There are various reasons, from location to the attitudes of American workers. And changes in schedules and lifestyle have affected one of the former staples of summer workstudents.
The situation is bad for staffing professionals in the industry, said Jacob Sapochnick, a San Diego, California-based lawyer whose practice is devoted to immigration law. Even though they can hire local people, they can never rely on them for the full term, he said. If you have a large hotel, need 50 housekeepers and hire locally, the turnover is very high. They find a better job or one that pays more. When you have H-2B workers, they know they have them for 10 months. Their visa depends on them working at that hotel.
The more turnover, the less likely the hotel will function properly, Sapochnick said.

 I have another question concerning EAD. I have a valid h1 visa stamped on my passport till June 2007. I have EAD and AP as well. On my return from India last month the inspector at the POE did not let me enter on my h1 and instead asked me to use my AP. He stamped my I 94 as entering on AP but he did not cancel my h1. Now what status I am on? H1 or AP? My EAD is expiring on 23rd Jan 2007 so if I am no longer on h1 then would I have to come out of job till I get another EAD? Won't this make me go out of status? Please advise.

The text is printed on your SSN card based on your visa status at the time of application. EAD is also a temporary status, this also requires a renewal. Hence, you would not be able to "remove" the text from your SSN card until your receive the GC.
Hi, Sorry if this has been asked already.. I am on H1B and the primary applicant... Can I change my SSN to remove "Work with Authorization only" statement on SSN by using EAD?
I am planning to stay on H1B and I dont want to invalidate H1B by doing this.
Thanks in advance!

As long as your Advance parole is not expired, you should be able to travel with it. If your Advance parole is going to expire around the time you are planning travel; you should renew your advance parole.
As far as I can see, yours is a straight forward case.

The process is similar to what one would follow for the regular H1B's. Starts with filing the prevailing wage determination with the labor dept and then filing the I-129 papers with USCIS. The only difference would be the fee, non-profit organizations don't have to pay something like a training fee, (I am not sure). You can file it anytime and start working as soon as you have the receipt number.
Hope this helps

Hello,
I am currently working on OPT. My company has just applied for my H1B visa. Assuming it gets approved in 2-3 months time (i.e. in March), when can i have it stamped? Can i go back to my home country to get it stamped in April or will i have to wait till 1st Oct 2011 to get it stamped?
What is the starting date on your H1-B petition?
You cannot get a VISA stamp earlier than within 20 days of the start date (I actually do not recall if it is 20 days or 15 days -- but it is around that many days).

Dear friends,
I received card production e-mail today.
My PD June 2007, RD Oct 2007. No REFEs. EB1 India.
Thanks for all the help and good counsel.
Lesson from this experience: Learn to handle delays. Take things in your stride. Do not make GC as end of your life. We can work anywhere and be happy, though US is a preferred destination.
In this process, I made so many friends and learned to heed others views and good advice.
Will continue to work for IV.
Congratulations
