The US Department of State has released the new Visa Bulletin (http://travel.state.gov/visa/frvi/bulletin/bulletin_4575.html) for October 2009. In family-based categories, there is very slight movement forward, but just by a few weeks or months in most categories. However, Family 1st Preference for Mexico moves forward by 17 months
Employment-based categories remain "Current" for all 1st preference applicants, and for 2nd preference from Mexico, China, and countries other than India and China.
The biggest change is that the bulletin once again lists priority dates for 3rd Preference and Other Workers. These categories have been "Unavailable" since the May 2009 bulletin. Unfortunately, the priority dates listed on the October bulletin are all at least a few weeks behind the dates listed the last time, in the April bulletin. This may be the Visa Office being conservative in its first allocation of numbers for the new fiscal year. Let's hope so, and hope that they move forward in the next few months.

Hi,
I've read conflicting information on whether one is eligible to receive unemployment benefits.
Specifically, i understand as a primary applicant in AOS status, one can not claim such benefits. But how about a derivative spouse, working on EAD , who lost her job? Can she claim such benefits as unemployment insurance. I've read that unemployment insurance should NOT be construed as a public charge, since its paid by the employer , when the employee is working.
So is it safe to get the basic unemployment benefits for a derivative spouse working in AOS status?

Yes, a derivative spouse can avail unemployement benefits and not jeopardize green card. Make sure she is eligible as per state laws. Each state has a different rule on who is eligible. Do some homework by calling your local unemployement office. I know of at least couple of immigration lawyers who discussed this on their newsletters. I know sheela murthy's website had that info too. Google for it and read.....

Is it true that H4 spouse, who do not have SSN are not eligible for tax rebate if while filing a joint tax return for 2007 ITIN is used for spouse.
It seems ITIN is given to illegal aliens too and hence it is not possible for IRS to determine which ITIN holders are legal and which are illegal. Thus they are not going to give tax rebates to ITIN holders.
My wife is on H4 and has a EAD/AP. Should I apply for SSN to receive the tax rebates? But since the tax rebates are based on 2007 tax return I will have to file the tax return using her SSN to get the rebates.
Also will SSN affect her H4 status if EAD is not used?

I would suggest to apply for the extension now and atleast carry a application receipt with you. And if you are planning to enter the county in July - Sug time, frame, I would suggest that you carry the approval notice as well.
I had the same issue with H1B. Even through my H1B was valid but it was expiring within a months time when I was re entering US after a business trip. I was suggested by my lawer to carry the H1B extension approval notice.

Yes, its possible. The only conditions are - your port of entry MUST be Newark, NJ & you MUST rent the apartment at Whitehall Gardens, Somerset.
If you dont meet any of these, USCIS will not allow you to convert from visitor to H1B

I have received all the receipt notices for I-485/AP/EAD for myself/wife.
Situation is this:
My current H1B expires on the 30th of September 2007 and I have applied for 3 year extension under premium processing last week.
If for whatever reason my H1B extension is denied then what are my options? First off, would it invalidate my I-485 application as it is employment based.
I believe if the answer to above is no, then I can just use my EAD and continue working.

You will have 10 days from day of the denial to leave the country unless you file for Motion to Reopen (MTR).
Did you try filing another H1b through another employer after the RFE?
If that is the case and if you have the LIN number then you may be able to continue working with your current client (if new employer and client etc are ok with it).
If you have all the documents to go for MTR then you can go for it. I am not an attorney but this is per my knowledge.

My friend's on her 6th year H1B and it will expire on Sept 10, 2010. A PERM labor was filed and the Labor went into an audit, responses were sent immediately.
If she transfer her H1B to new company.
1. Can she ask for 1 year extension based on her pending labor? Does she need to wait till the labor gets approved?
She can get one year if the LC is pending for 365 days, as previous poster said. However, the new company needs to be able to file a new PERM immediately, so she can get an 8th year extension. It is very unlikely that the old company will keep the permanent residence process going once she changes jobs.
2. Can she use Premium Processing for H1 transfer?
Yes, but if she's maintaining status she can change employers on filing the new H-1B. The company doesn't need the expense of PP.

Due to Iceland's volcanic ash my MIL trip has to be postponed. She was on visitor visa. We filed an extension with USCIS and paid $300. She left US as soon as flights started to resume.
USCIS approved her extension 30 days after she left US.
a) Can we seek a refund because this extension has to be filled due to reasons beyond our control
b) In the future how to seek a fee waiver (any tips or advice please).
c) Can we seek fee waiver when we e-file a petition.
