I agree with you that you need to go with lawyers who are really specialized in immigration especially when the case is complicated.
I know a person whos company lawyer screwed up the case. (They are from a very reputed law firm). Then she went with Murthy, they did a great job and got it done for her. They charged her a lot but it was worth it.
So get the best out there. It may be expensive but if it fixes your case its worth it.

All,
My current job desc requires an MS + 3 or BS + 5 years experience, with special certification like six sigma required. When my labor was filed, I had exactly 3 years of experience. The above was what I filed for my PERM application. I am planning on moving to another job where the job description is similar ( my i-140 is approved and my i-485 has been pending for more than 6 months) , but the new job requires an MS + 6 years or a BS + 8 and no special requirements. I gained 3 more years of experience with my current job description, but does that count since I gained it after my PERM was filed? Also, do educational requirements matter in order to port? any help is greatly appreciated..

Sure. You need to work outside the US for the sponsoring company in a managerial capacity for 1 out of the 3 years prior to filing the I140. So if you are on a H1B and are a manager, you can sign up for an assignment abroad to fulfill that requirement.

Hi,
Need quick suggestion:
Company A filed for GC. Labor and I-140 was approved. I-485 was filed during July 2007.
I changed employer in June 2009; replied to RFE and filed AC21 in July 2009.
I came to know that my GC sponsring company is going to close the company soon. My current immigration attorney is suggesting that if that happens; and if INS came to know that GC sponsring company is closing down, they will revoke my I-140.
Is it true? I thought after AC21 is invoked; whatever happens to GC sponsring company, it will not impact my GC application in any way.
Please advice.

Your I140 cannot be canceled/revoked unless USCIS detects that it was obtained fraudulently.
Your GC application will not be impacted. Just find another employer and join them with EAD.

Hi Everyone,
I need help urgently , my port of entry is SFO and on the I94 I have not written my complete name as I didn't understand the the importance of I-94 . When I tried to apply for SSN i was told that the names has to match with the name written in I-94 at the port of entry and the person said that I have no other option to change the name so I agreed upon the name which on SSN . Now I googled out and came to know that I can change the name in port of entry . It would be of great help for me if any one can help me out getting out of this situation .

Has anyone been able to call USCIS premium processing toll free number today and talk to an Officer. I have been unable to get to an Officer today but was able to talk before. I am wondering whether there is a limit on how many times you can call(I have called 3 times so far in 10 days) or if you can't call after so many days have passed after your application is approved.

It's interesting that people rely on consultants and body shoppers to enter this country and then curse them.
I doubt that so many people would have entered the US if it hadn't been for these very consultants and body-shoppers. Everyone knows that they pay less and take a cut of the salary. People curse them all the time and yet when it's convenient, they'll use them to get things like H1B application, labor substitution, etc. done.
I am on an H-1B visa I had a confusion regarding my wife's case. She is on H4 visa and her H4 visa was extended to September, 2009 when I changed my employer (XXX) last year. However, her passport carries H4 visa which expires in Oct. 2007 (this was through my previous employer, YYY). Both our I-485 are pending and we both received our EAD last month. She wants to use her EAD to work in future.
A twist is that a consultant had filed for her H-1B this April and we don't know if her H-1B came through or not. He is not telling us. We just don't want to deal with that scumbag. Can we just ignore him and forget about it? Since her I-485 is pending she has a lawful status (Pending AOS), right? Please let me know what you think.

Call USCIS and verify your address. Have you moved receently - sometimes your AR11 change of address may not have been recorded on your case.
I am sure, you will get it anytime.

I changed my address last month and they sent the 485 approval notice to the new address, so I think they've got the correct address. Just wondering why it was taking a while...

There is no issue if your wife is the derivative applicant and gets her EAD through you. You can also start but it is more complicated since your business has to be doing excatly the same thing as your labor application. Also, i think you should get lawyers advice if you are starting it. There is no complication for your wife to start a business.

I am in the same situation . The responses from the lawyer are Incorrect .I spoke to my companies attorney and they advised me to apply the H4 extension in Premium and then go with the new H1 in regular so that your H4 ext will be approved first and able to maintain the status until Oct 07

Let the flowers reach them; let the suitors file the suit. But don't you think we should start a 'Seek information' campaign. Each of us write letters and faxes to DOS and USCIS and request them for this.
In May'07 the DOS moved forward the visa dates by 2 years for almost all categories. Now since USCIS have already receipted (or will soon do it) all the June applications, they should be in a position to release the information on how many applications they received for each category and for each country. We will request both the agencies to work together and release some kind of statistics some predictions like what they expect for Sept visa bulletin and further. We are living in dark and information like this will give us some insight and will let us plan our careers.
Guys please think about this seriously, I think this is the need of this hour.

My Green Card was recently approved. But, due to retrogression I had not filed for my wife's green card.We did file her I-485/EAD/AP during the month of July. My PD is around 2003, and I dont see my wife's GC being approved very soon.
My questions are:
1. What kind of documents are required in the future? Lets say, I start a company and work for my own company. In that scenario, what are the requirements I need to fulfill to keep her application in good standing.
2. What happens if I go without a job for a few months(between consulting gigs). Does this adversely impact her application.
3. At the minimum, how do I keep her application in good standing, and be ready to respond to future RFE's.
I am not sure if these questions were discussed in this forum. I would appreciate if anyone can point me to any links.
